If you have suffered serious complications from using the Mirena® IUD device, you may have grounds for a civil lawsuit against its manufacturer. At Michigan Injury Lawyers, we are dedicated to fighting on behalf of those harmed by dangerous medical devices and other defective products. Often these types of products are marketed deceptively by manufacturers who put profits ahead of safety, who hide important information about potential side effects, and who engage in other questionable tactics to improve their profitability at the expense of consumers. Our experienced Mirena® IUD attorneys can review your situation to determine if legal action is advised to help you obtain fair monetary compensation for the damages you’ve suffered.
The Mirena® IUD Story
The Mirena® IUD (intrauterine device) is a small T-shaped hormone-releasing device that is placed inside a woman’s uterus to prevent pregnancy. It is a long-term form of reversible birth control designed to last up to five years. Since its approval by the FDA (Food and Drug Administration), however, more than 70,000 complaints have been made by women claiming serious side effects and complications from its use. Many of these complaints have led to Mirena® lawsuits contending that the product is faulty and dangerous. Mirena®’s manufacturer, Bayer, has been accused of intentionally and knowingly marketing a dangerous consumer product, of false advertising, as well as hiding known information about the potential risks it carries.
Since its initial approval in 2009, the FDA has since issued a warning about the potential complications that can arise through its use. These are listed in an FDA publication. These side effects include:
- A higher risk of ectopic pregnancy which can lead to loss of fertility
- Should pregnancy occur, an increased risk of miscarriage, sepsis (a life-threatening medical condition caused by the body’s reaction to infection), and premature labor and delivery
- Should pregnancy occur, septic abortion may follow, in which septic shock and death may ensue
- Severe pain followed by sepsis after insertion of the device
- An increased risk of pelvic inflammatory disease which can lead to tubal damage and infertility
- Embedding of the device into uterine tissue which is often difficult to remove and may require surgery
- Perforation of the uterine walls by the device which calls for its removal. Removal may require surgery. Once a device perforates tissues, it may migrate within the body causing infection and damage to other areas, such as abscesses, intestinal obstruction, peritonitis (inflammation of abdominal linings), and erosion of adjacent tissues.
Mirena® Lawsuits
A 2008 multimillion-dollar Bayer advertising campaign aimed at women resulted in an estimated doubled number of women using the device. This was followed by thousands of reports of device dislocation, uterine perforation, and other serious complications. As a result, at least 100 lawsuits have been filed on behalf of injured women against Bayer in a New Jersey court as well as dozens more in federal court.
